试论违法建筑的认定及其处置——以济南市“拆违拆临”工作实际为例

On the Cognizance and Disposal of Illegal Construction——Taking the Actual Practice of Jinan as an Example

违法建筑的大量存在严重挤压城乡居民的生存空间,制约城乡科学发展。由于我国法律、法规没有界定违法建筑的涵义,给行政执法带来诸多不便。为此,有必要梳理我国法律、法规的相关规定,以便正确认识违法建筑的违法表现,明确违法建筑的认定主体、强拆主体以及强拆程序,从而确保行政机关依法行政,保障当事人合法权益。

A large number of illegal constructions severely squeeze the living space of urban and rural residents, and restricte the scientific development of urban and rural areas. As China＇s laws and regulations do not define the meaning of illegal construction, it brings a lot of inconvenience to the law enforcement by the administrative. Therefore, it is necessary to sort out the relevant provisions of China＇s laws and regulations, in order to correctly understand the illegal performance of illegal construction. Making clear the subject for reeognition and the demolition program is to ensure that the administrative organs according to law, and safeguard the legitimate rights and interests of the parties.
