中学生网络言论的法律规制问题研究——美国的经验及对我国的借鉴意义

Research on the Legal Regulation of Network Speech in Middle School Students

由于中学生仍然在学校接受教育,因此,其言论肯定会受到其所在学校的规制。该言论的规制缘由大抵是为了维护学校正常的教学管理秩序,为了保护学校教师和其他学生的权利。对于发展完善学生健全的人格来说,表达自由是弥足珍贵的,因此,学校对待中学生的言论要尽量采取宽容的态度,除非其言论严重扰乱了学校秩序或侵犯他人权利。

As students are studying at school,their speech certainly will be regulated by their school. The reason of the problems are mostly to safeguard the normal teaching management order of schools,and protect the rights of teachers and other students. For students develop a sound personality,freedom of expression is precious,therefore,the school should treat the student speech with a tolerant attitude,unless the speech was seriously disrupt the order of school or infringe other＇s rights.
