北美自由贸易区整合式边境管理法律的中国启示

Enlightenment on China of Integrated Border Management Law in North American Free Trade Area and Their Enlightenment on China

整合式边境管理具有跨国边境管理的深度合作和国内边境管理部门的整合两大特点。北美自由贸易协定是依托于经济条约的整合式边境管理国际条约,其整合式边境管理法律制度推动了国家边界的转型,实现了边境管理部门的整合、国际法与国内法的协调、区域边境管理的风险共担。借鉴该制度,我国应以自由贸易协定为依托,建设整合式边境管理国际法律框架;以"软边界"为核心,推动整合式边境管理理念创新;以经济发展带动安全发展,推动经济框架下的安全合作;以"大通关"为背景,推动我国口岸出入境部门的整合;以出入境新政为起点,建设国内移民管理"新常态"。

Integrated border management has two major characteristics of the deep cooperation of transnational border management and the integration of domestic border management. The North American Free Trade Agreement is an international treaty of integrated border management based on economic treaties,and its integrated border management legal system has promoted the transformation of national borders,it realized the integration of border management department,the coordination of international law and domestic law,the risk sharing of regional border management. With reference to the system,China should be based on the free trade agreement,thus construct the international legal framework of integrated border management,with the ＂soft bound＂ as the core,promote the idea innovation of integrated border management,use economic development to promote safe development,implement security cooperation under the economic framework,with the ＂big customs clearance＂ as the background,promote the integration of China＇s port departments of entry-exit,starting with the new policy of entry-exit,and construct the ＂new normal＂ of domestic immigration management.
