摘要
我国《专利法》并未对请求保护色彩作出法律定义。形状、图案和色彩三要素是相互依存的,其界限有时难以界定。外观设计专利权的保护范围不因请求保护色彩而扩大或缩小。外观设计专利申请人请求保护色彩会对外观设计专利侵权的判定产生影响。
China＇s patent law does not make a legal definition of the request for protection. Shape, design and color are the elements of the design, and the scope of protection of the patent right of design is not enlarged or reduced by the request of protecting the colors. The design patent APPlicant＇s request for protection of color will affect the determination of infringement on the design patent.
