摘要
随着智能手机的兴起和移动互联网的发展,移动互联网APP标识设计的纠纷产生。APP标识实质上属于一种新的商业标识,与其他商业标志具有明显区别,一旦被他人抢注,同名APP将无法进入APP应用商店。未经他人许可使用他人设计的APP标识构成商标侵权。APP应用商店由于自身特殊的经营管理模式,不同于普通的网络服务提供商,因此无法援引"避风港原则"进行免责。一个好的APP标识设计应该具有可识别性、创新性和品牌特色。
