立法协商概念界探

On the Interpretation of Concepts of Deliberative Legislation

概念是判断、推理的要素,概念的明确和统一是开展研究对话的基础,是我们制度建设的前提。现有立法协商概念的基本属性不明,与其他概念界限不清,不利于立法协商实践。在我国,立法协商概念与协商民主、人民政协、公众参与立法等概念联系紧密,彼此之间有着微妙的联系,澄清这些关系能够厘清立法协商的基本属性,明确与相关概念的界限。科学的立法协商概念,既需要符合民主理想,又需要符合我国国情并适于操作。因而,立法协商概念的定义,有必要将协商民主理论与我国语境相结合。

bConcepts help to judge and reason. A clear and unified concept is the basis of a study on communication and the premise of constructing a system. The concepts of current deliberative legislation are not helpful to its practice since they are devoid of definite basic attributes and any distinction from other concepts. In China,a close connection exists between the concepts of deliberative legislation and those of deliberative democracy,the CPPCC,public participation. Clarification of these relationships can define the basic attributes of deliberative legislation and distinguish it from relevant concepts. A scientific concept of deliberative legislation can both meet the democratic ideal and the national conditions. Therefore,it is necessary to combine the theory of deliberative democracy with Chinese context in defining the concept of deliberative legislation.
