Basic Review and Fundamental Perfection of the Contemporary Criminal Law Code

1997年刑法典(简称97刑法典)是新中国成立以来刑法立法的经典之作。它开启了罪刑法定时代,筑起了人权保障的刑事法治防线,开辟了刑法理论研究的新局面,奠定了中国刑法走向世界的基础。立法机关坚持与时俱进的精神,联动刑事政策指导立法,根据经济社会发展及时修法予以回应,注重促进立法与理论的良好互动态势,始终保持刑法立法的适度活性,使刑法典在不断修改中得以完善。十九大的胜利召开为完善中国97刑法典指明了前进的方向,刑法修正案仍是修法的"新常态"模式,目前全面修订97刑法典为时过早。应高举立法科学化的伟大旗帜,不断强化中国刑法典的时代适宜性。应加强对刑法总则的理论部分的修改工作,抓好破坏社会主义市场经济秩序犯罪和网络犯罪等重大和新兴领域的立法修改工作。

The Contemporary Criminal Law Code( 1997) is the new and classic criminal law since the construction of the People's Republic of China,which starts the era of legality,establishes the criminal line of human rights protection,initiates the new situation of criminal law research and lays the foundation of Chinese criminal law going out to the world. Criminal code is always in the continuous development of the perfect,and China's legislature adheres to the spirit of advancing with the times. The legislature employs the criminal policy to guide legislation,amends the Criminal Law Code according to economic and social development in a timely manner,focuses on promoting the good interaction between legislation and theory,and always maintains the appropriate activity of criminal law legislation. The 19 th National Congress of the Communist Party of China has specifies the forward direction for improving China's criminal law legislation,however,the amendment to the criminal law is still in the"new normal"mode of law amending,so it is too early to revise the Criminal Law Code. At present,we should hold the great banner of scientific legislation highly to continuously strengthen the suitability of the Criminal Law for the Age. Moreover,the revision of the theoretical part of the general principles of criminal law should be strengthened,and the major or emerging areas of revision such as the crime of undermining the socialist market economic order and cybercrime should top the agenda.
