摘要
我国《食品安全法》在2009年发布之初就明确规定:食品企业应承担社会责任。但由于法条过于抽象、缺乏具体措施支撑、操作性和参与性不强,使得实施效果差强人意。2015年,修订后的《食品安全法》在责任落实方面有了新变化,但仍存在法律概念不明确、激励机制不足、责任追究机制有待完善等问题。本文认为,应以出台专门配套法规的形式明确食品企业社会责任的概念和内容,充分发挥政府监管部门、行业协会、消费者等多方利益相关者的作用,通过构建和完善企业信用记录与查询系统、推广食品安全责任保险、完善激励与保障机制等方式,引导和推动食品企业主动承担社会责任并与政府行政监管相结合,形成保障食品安全的社会共治机制,以确保食品企业切实承担社会责任。
The food enterprises" social responsibilities have been stated in the "Food Safety Law" of our country all the time.However,due to the too abstract article,lack of supportive specific measures and weak operational and participatory characters,the practice effects were disappointing.The "Food Safety Law" has made great progress in responsibility imple- ment mechanism since the revision of 2015,while there are still some regrets such as unclear legal conception,lack of incentive mechanism,inefficient responsibility accountability mechanism,etc,.It's suggested to clarify the conception and content of food enterprises" social responsibilities through specific supporting regulations.Meanwhile,we should give full play to the functions of the government supervision departments,industry associations,consumers and other multiple stakeholders.It's also suggested to build and perfect enterprise credit record and query system,to promote food safety lia- bility insurance and to perfect incentive and guarantee mechanism,so as to guide and promote the food enterprises to bear their due social responsibilities actively.With the combination of government administrative supervision,the society multi-governance mechanism would be formed to safeguard food safety.
