摘要
作为一种新兴经济业态,网约车的运行方式与传统出租车行业存在较大差异,其所呈现的互联网特性给政府规制带来较大难度。从规制原则看,政府规制应善于借助个人、行业的自我规制,并在一定程度上进行适度规制,形成政府规制与自我规制的良性互动。从规制方式选取看,政府应重新整合传统的成本—收益分析、行政许可等规制手段,同时发挥软法对共享经济模式的规制作用,进而通过具体的规制措施实现网约车运行的规范化与合法化。
As an emerging economic format, network cars is a new model developed with the rise of the sharing economy. Compared with the traditional taxi industry, there is a big difference between the opera- tion mode of the network cars and taxi, also the Internet characteristicswhich brings great difficulties to the government regulation. From the principle of regulation, government regulation should be good at self reg- ulation of individuals and industries, and moderate regulation to a certain extent, and form a benign in- teraction between government regulation and self-regulation. From the selection of regulation tools, the government should re integration of traditional cost-benefit analysis, such as administrative licensing reg- ulation tools, and exert the soft law of sharing regulation of economic model, and then through the regula- tion of specific measures to realize thestandardization, legalization of network cars operation.
