摘要
阐述了招标工程项目合同的成立与生效过程,透视了建设工程合同履行时出现的合同双方的问题现象,探析了"工程合同履行过程缺少监督,针对违约情形缺欠追责机制,合同义务履约后期缺乏管控"三个普遍存在的问题,提出了"施行多时点签到约束法,运用诚信黑名单警示法,增设实到/应到比处罚法"三点探索改进建议,为今后的合同管理工作提供了有益参考与借鉴。
