论我国非常法定夫妻财产制的立法建构

On the Legislative Construction of China's Special Statutory Conjugal Property System

非常法定夫妻财产制为法定夫妻财产制的形态之一,其立法目的在于保护夫妻各方的财产权益和保障家庭扶养职能的履行,同时维护交易安全与第三人利益。值此我国"民法典婚姻家庭编"编纂之际,基于非常法定夫妻财产制的立法功能与立法价值,为满足我国部分夫妻在婚姻期间因特殊情况对实行非常法定夫妻财产制的需要,建议借鉴大陆法系国家和我国台湾地区立法经验,从我国实际出发,在"民法典婚姻家庭编"中设立非常法定夫妻财产制。

As a constituent part of the statutory conjugal property system, the special statutory conjugal property system, which aims to protect property rights and interests of spouse, ensure the implementation of family support function, maintain transaction security and third party interests. On the occasion of codification of Marriage and Family Volume in Civil Code of China, for the purpose of the legislative function and value of special statutory conjugal property system, in order to meet the need of some Chinese couples who want to carry out the special statutory conjugal property system due to special reasons, it is necessary to establish special stat- utory conjugal property system in the Marriage and Family Volume in Civil Code of China on the basis of foreign legislation and the actual conditions of China.
