摘要
改革开放以来,社会劳动问题是我国经济社会发展中极为重要的问题。为解决这一重要问题及其在不同阶段衍生的具体问题,我国先后制定了极具时代特质的公共就业服务政策,在公共政策的基础上,颁布实施了《劳动法》《就业促进法》等法律,构建公共就业服务法律制度和劳动力市场法制。通过法律与公共政策的互动与统合,公共就业服务运行机制逐渐形成、完善,其主旨是保障公民实现高质量的就业、体面劳动和劳动力资源的优化配置。在劳动力市场法制的框架之下,公共就业服务的主要内容包括就业服务、创业服务、培训服务、援助服务等,实施机制包括政府责任的承担机制、社会组织的提供机制、公共财政的保障机制、行政与司法的监督救济机制等。
The social labor issues has been one of the important issues since China's reform and opening up. In order to address the social labor issues and its derived specifc issues which come with different social stages, China has made the public employment service policy characterized by the feature of era. For example, the "Labor Law", "Employment Promotion Law" and other related laws are promulgated during the process on implementing the public policy. By interacting and integrating on Public Policy and Law, the operation mechanism of public employment service has been set up. The public employment service law is aimed at improving the quality employment, making better working environment and giving more respect to the laborers. The public employment service consists of employment services, business services, training services, and assistance services, etc. and its operation mechanism consists of the mechanism of government responsibility, social organization, public fnance, and supervision and remedy on administration and judicature, and so on.
