治理视域下的社区居民维权实现路径

The Realization Path of the Rights of Community Residents in the View of Governance

社区居民维权在全面依法治国的大政方针下正在逐渐升温。面对社区居民和开发商、物业服务企业、管理职能部门、组织之间侵权发生的现实,社区居民维权特征呈现显著变化。同时,体现出社区居民维权主体受限、维权方式激进和维权行为理念缺失三个方面的维权困境。从社会治理角度看,社区居民维权是参与社区治理的具体表现。从政府、社会、居民三个层面入手,政府合理服务引导,社会组织制度的建立和完善,提升社区居民的自治能力成为社区居民维权的现实路径。

The rights and interests of community residents are gradually warming up under the general policy of governing the country according to law. Faced with the reality of infringement between community residents and developers, property service companies, management functions and organizations, the characteristics of community residents＇ rights protection have shown significant changes. At the same time, it embodies the rights-protection dilemmas of the three main aspects of the community residents： the main body of rights protection is limited; the way of rights protection is radical; and the concept of rights protection is absent. From the point of view of social governance, the rights pro- tection of communily residents is a concrete manifestation of participation in community governance. Starting from the three levels of government, society and residents, the gov- ernment guides and organizes and improves social organizations so as to enhance the autonomous ability of community residents to become community residents realistic path of rights protection.
