浅谈海外供应商知识产权风险管理

Overseas Supplier Intellectual Property Risk Management

随着国内企业逐步走出国门,与海外供应商展开合作,企业所面临的知识产权风险也日益增加。本文研究了在与海外供应商合作中各个阶段主要的知识产权风险,提出了降低风险的管理建议。通过供应商选择阶段技术自由实施尽职调查、合同磋商和签订阶段知识产权风险管理、合同履行阶段知识产权风险跟踪、责任承担阶段知识产权管理协作四个方面对海外供应商进行分阶段知识产权风险管理,实现规避知识产权风险的目的。

With the domestic enterprises to step out of country, to cooperate with overseas suppliers, intellectual property risks faced by enterprises are increasing. This paper studies the main intellectual property risks in the cooperation with overseas suppliers, and puts forward some suggestions to reduce the risks. Due diligence by the vendor selection phase, contract negotiations and signing stages of intellectual property risk management, contract performance stage intellectual property risk tracking, phase management responsibility cooperation in four aspects of intellectual property rights overseas suppliers phased risk management to achieve the purpose of avoiding the risk of intellectual property rights.
