申请人对申请文件的修改应当符合专利法第三十三条的规定,对于权利要求和说明书中技术方案的修改是否符合上述原则,审查标准比较明确。然而,对于说明书附图的修改如何判断,审查员仍存在困惑和分歧。审查指南中并未提供允许的修改示例,而审查实践中缺少对此类情形的指导。针对上述问题,本文针对实用新型审查过程中申请人常见修改方式的审查进行探讨。

The amendments to the application for a patent for invention or utility model shall comply with the provisions of Article 33 of the Patent Law. There is a clear standard about whether the amendments to the application of claims and description go beyond the scope. However, there are still doubts and differences about how to judge the revision of the appended drawings. There is no provision for revision in the guidelines for patent examination, review guidelines, and there is a lack of guidance for such cases in the review practice. In view of the above problems, this paper discusses the amendments of the applicant＇s common modification methods in the process of utility model review.
