TISA框架下数字贸易谈判的焦点争议及发展趋向研判

A Study on Controversies and Development Tendency in Digital Trade Negotiation under the Framework of TISA

数字贸易相关议题最早出现在TISA框架下的第二轮谈判之中。本文尝试从TISA谈判文本入手,梳理数字贸易谈判进程及其条款构成,对数字贸易自由化与在线消费者保护等焦点争议展开讨论并提出应对思路。在此基础上,研判TISA的发展趋向:从中短期看,由于成员间的利益诉求矛盾重重,TISA谈判本身注定步履维艰,加之美欧双方的"漠视",TISA很可能重蹈TPP覆辙,但由于数字贸易始终是美国的核心利益所在,TISA依然会是美国推行其数字贸易治理理念的理想平台,其数字贸易谈判依旧潜力无限。

Digital trade-related issues first appeared in the second round negotiations under the TISA framework. This study tries to comb the process of digital trade negotiation and its composition based on the TISA negotiation text, discuss the key controversies such as digital trade liberalization and online consumer protection, and put forward some countermeasures. Finally, the study proposes the development tendency of TISA： From the medium and short term, due to lots of contradictions of members for interest demands, TISA negotiations is bound to be struggling, and both the United States and the Europe Union ＂ignore＂ it. TISA may repeat the TPP mistakes with great possibility. However,the digital trade has always been the core interests of the United States, TISA will still be the ideal platform for the United States to pursue its digital trade governance philosophy, and the potential of related digital trade negotiations remain unlimited.
