Modern Transition of Chinese Traditional View of Justice and Construction of Core Social Values

转型期中国社会的价值观念变革和核心价值观的建构是围绕公平正义这一价值"圆心"而展开的,使其与传统正义观的现代转化相融合是建构具有中国特色、民族特色和时代特色的核心价值观的必由之路。群体本位的德性正义观作为中国传统正义观的基本内涵和根本特质,它的现代转化必须围绕其"三位一体"的有机结构而展开,坚持德与法、形式正义与实质正义、个体与群体的辩证统一的可能性原则。只有实现中国传统正义观的现代转化,转型期中国社会的核心价值观才有其建构生成的原生态土壤。

During the transition period,the value reformation and the construction of core values of Chinese society were realized centering on fairness and justice. Integrating fairness and justice with the modern transformation of traditional view of justice is an inevitable road to constructing core values with Chinese characteristics,national features and epoch characteristics. The modern transition of moral justice view of group standard as the fundamental connotation and feature of China＇s traditional view of justice has to be realized by centering on the organic structure of ＂ three in one＂,adhering to the principle of probability of the dialectical unity between moral with law,formal justice with essential justice and individual with group. Only by realizing the modern transition of China＇s traditional view of justice can core social values during the transition period have the natural soil for its construction and generation.
