摘要
犯罪侦破与侦查取证两种活动有极强的联系,且常出现时空上和行为上的同一,但两种活动都不同的原理基础。本文将"犯罪侦破"作为专门的问题来认识,论述侦查行为的犯罪侦破属性,探讨犯罪侦破作为一个理论体系的基本内容,构建犯罪侦破理论体系。将"侦查取证"的内容明确,论述侦查行为的证据收集属性,探讨这一理论体系的理论基础,作为侦查学系统的另一理论体系。
Although there is a strong connection between the investigation and the collection of evidence and both behaviors have the same temporal and behavioral characteristics, these two activities are different in principle. Therefore, it is necessary to explore the basic theory of the two types of activities： One is the detection of crimes for the purpose of detection activities; The other is evidence investigation activities for the purpose of evidence collection.
