新时代我国社会主要矛盾发生了转化,人民群众迫切要求生态环境尽快"美起来"。与此相适应,我国生态文明立法要"实起来",法律实施要"严起来"。在立法领域,建议将生态文明载入宪法,改革立法机制,加强生态文明立法,尤其要强化生态文明法律责任制度;立法机关还要尽快组织清理现有环境法律法规,消除某些地方"立法放水"的现象。同时,要强化环保督察制度,改进环境监测管理制度,确保生态文明法律实施到位。要严格环境司法,支持环境公益诉讼,促进生态损害赔偿制度得到全面落实。要创新全民守法制度,增强人民群众遵守生态文明法律的内生动力。要完善党内法规,探索运用党内法规推进生态文明建设的具体途径。

In the new era,the major social contradictions in our country have been transformed,and the people have an urgent desire for a beautiful ecological environment. In accordance with this,the legislation of ecological civilization in China should be real,and the implementation of the law should be strict. In the field of legislation,we should incorporate ecological civilization into the constitution,reform the legislative mechanism,and strengthen the legislation of ecological civilization,especially the legal responsibility system of ecological civilization. And the legislative authority shall also clean up the existing environmental laws and regulations and to correct the phenomenon of " drainage" in some local legislation. In the meanwhile,we should strengthen the central environmental supervision system,and improve the environmental monitoring and management system in order to ensure the implementation of ecological civilization legislation. We should strictly enforce environmental justice,support environmental public interest litigation,and promote the comprehensive implementation of compensation system for ecological damage. We should innovate the universal law-abiding system,enhance people's internal impetus to abide by the law of ecological civilization. We should improve the inner-party laws and regulations,and explore the concrete ways to promote the construction of ecological civilization by using the laws and regulations of the party.
