我国宅基地流转法律问题探究

The Legal Issues of Homestead Circulation in China

宅基地使用权是我国农村居民重要的住宅福利制度,但伴随着城镇化的快速发展,大量农民进城务工,宅基地大批闲置,造成了"乡村空心化"现象和严重的土地资源浪费。在全国土地资源紧缺的大背景下,建立与完善宅基地流转机制是解决宅基地闲置的一项可行方案。但是我国关于宅基地流转的法律规定在实践中可操作性较低,并且各地方政府的规定不一。文章总结了国内较为典型的土地流转模式,并结合现实存在的问题进行分析,提出了完善土地流转机制的参考方案。

The homestead land use right is a very important welfare for Chinese rural residents. With the rapid development of urbanization,a large number of farmers go to the city to work so that many homestead lands are left unused. It causes the phenomenon of"empty villages". It is a waste of lands. Considering the land resource shortage,to establish a homestead circulation system is an effective way to solve the problem of homestead land shortage. However,the corresponding regulations are not feasible and operational. There are different rules in local governments. The typical models are introduced,based on which a circulation plan is proposed,considering the practical problems.
