医疗卫生监督员对执法认知的调查分析

Investigation and analysis of the cognition of medical and health supervisors on law enforcement

目的了解医疗卫生监督员对执法的认知情况,以便采取针对性措施,不断提高综合监督执法能力。方法对医疗卫生监督员进行问卷调查,获取其基本信息及对执法的认知情况,利用Excel 2007建立数据库进行分析。结果认为执法困难的主要原因为部门之间协调配合不足的占被调查人员总数的93.15%,认为执法困难的主要原因为经费、设备、交通工具缺乏的占被调查人员总数的87.33%,认为执法困难的主要原因为人力不足的占被调查人员总数的85.62%,其它还有管理相对人法律意识淡薄、物质装备不足、行政部门执法力度不够、行政干预、受害人不配合、与行政主管部门关系没理顺、监督员自身原因等各种因素。结论医疗卫生监督员执法困难影响因素较多,执法环境不能适应新形势要求。应通过加快立法步伐,明确监管职责,加强政府投入,转变监管方式,提高执法效能。

Objective To gain full knowledge of the law enforcement awareness of the medical and health supervisors in order to further improve the ability of comprehensive supervision and law enforcement in a more focused manner. Method Conduct a questionnaire among medical and health supervisors to collect their basic information and level of cognition of law enforcement. These raw data were then input into database through Excel 2007 and were further analyzed. Results The final results suggested that the dominant drivers to weak law enforcement were ineffective coordination and cooperation among departments（93.15%）,shortfall on funding, equipment, and transportation（87.33%）,and insufficient human resource（85.62%）.Complaints also encompassed, but not limited to, other areas such as poor law awareness from the management,shortage on material and equipment, weak law enforcement execution, administrative intervention, uncooperative victims,poor relationship with executive departments, and incapability of law enforcement supervisors. Conclusion There were various reasons which led to the difficulty on law enforcement. Old law enforcement framework was not adaptable to the evolving situation. In order to improve the efficiency of law enforcement, we should accelerate the legislative process, clearly define the responsibilities of supervision, strengthen government support and evolve the supervision method.
