卫生监督中行政合理性原则运用的法律问题研究

Study on legal problems in the application of administrative rationality principle in health supervision

文章从法律视角解读卫生监督与行政合理性原则的关系,以及在卫生监督领域引入行政合理性原则的理论和现实意义,对卫生执法者落实合理性原则实施行政裁量提出思考:关注行政合理性原则在卫生监督领域的特殊性,考虑引入"不合理"审查标准;将行政合理性原则适用于卫生行政立法、行政程序的选择裁量中;权衡行政合法性与合理性原则的关系,注意行政合理性原则的发展变化性。

This article analyzes the relationship between administrative rationality principle and health supervision and the theoretical and practical significance of bring administrative rationality principle to health supervision from the perspective of law,then makes suggestions on using administrative discretion with administrative rationality principle. Administrative rationality principle has its particularity in the fields of health supervision which we should pay attention to： introducing the ＂unreasonable＂ review standard, making the administrative rationality principle exist in administrative legislation and selective discretion of administrative procedure, weighing and balancing the relationship between principles of administrative legitimacy and rationality,concerning the expansibility and variability of administrative rationality principle.
