网络游戏直播画面的可版权性及相关著作权问题

网络游戏直播现今可谓耳熟能详,但是很多人在欣赏主播精彩的电子游戏竞技时,却常常忽略了背后涉及的著作权问题。理论上玩家操作游戏产生的动态画面,符合著作权法上的独创性要求,属于"视听作品"。玩家操作游戏的行为对游戏动态画面的产生不具有独创性贡献,著作权应归属于游戏开发者。网络主播游戏直播的行为落入"著作权人拥有的其他权利"的控制范围内,理论上构成侵权。但是从社会整体利益的高度考虑,网络游戏直播行为可认定为构成对原作品的"合理使用"。

People are quite familiar with online game live broadcast nowadays. However,while enjoying the fantastic E-sports played by the anchors,most people ignore the issue of copyright. Theoretically,when game players play the game,the dynamics images produced meets the definition of＂audiovisual work＂in the copyright law. The behavior that game players play the game doesn＇t have originality contribution to the production of the dynamics images in the game. The copyright should belong to the game developer. The behavior that the anchors do online game live broadcast is in the scope of＂the other rights the copyright owner entitled＂and it theoretically constitutes infringement. But consider the overall interests of society,the behavior of online game live broadcast can be considered as the ＂fair use＂of the original work.
