论认罪认罚从宽制度下说服教育讯问方法的创新

随着宽严相济刑事政策的深入推进以及认罪认罚从宽制度的实施,侦查讯问应紧跟法治步伐,进一步科学化、合理化以应对获取口供难的顽疾。作为一种常见的讯问方法,说服教育普遍存在着诸如说服教育空洞化、模糊化,说服教育技巧性与策略性界限不明,以及说服教育讯问方法与其他讯问方法结合不当等问题。说服教育应遵循重点讲述宽严相济刑事政策、阐述认罪认罚从宽制度的精神、把握讯问策略的界限、适度运用"硬审讯法"、坚守口供自愿性等原则。

With the development of Criminal Policy of Temper Justice with Mercy and the implementation of Leniency System of Guilty Plea, the investigative interrogation method should also follow the pace of the rule of law. Make it scientific and rationalized, in order to cope with the difficulty of obtaining the confession. Persuasion and education has many problems generally, such as the methods is hollowness, fuzzy, the skills and strategies is ambiguous, which combining with the other methods of interrogation methods is improper. The methods of persuasion and education should focus on elaborating the Policy of temper justice with mercy, explaining the spirits of Leniency system of guilty plea, grasping the boundary line of Interrogation strategies, using of ＂hard interrogation methods＂ reasonably, adhereing to the Interrogation principles.
