On the Constitutional Guarantee of Property Rights——Comparative Study from the Compensation Clause of the Constitution Perspective

在基本权利的体系中,财产权是生存的基础。英美法系和大陆法系的许多国家的宪法文本中,绝大多数都规定了征收补偿条款,来对财产权进行保障,美国和德国就是其中的典型。美国和德国宪法中的征收补偿条款,其对财产征收补偿范围、具体理论基础以及在具体案例中的应用都不相同,但却反映了相同的宪法价值我国政府对财产权的保障要与时俱进,及时转变航向,尽可能限制公权力对财产的侵害,平衡国家和公民之间的关系。

In the system of basic rights, property right is the foundation of survival.In many American law system and continental law system,the vast majority of the constitutions have on compensation terms to safeguard property rights, among which the United States and countries of Anglo- regulations imposed Germany are typical models. Although the range, the concret theoretical foundation and the specific application is different in the two countries, it reflects the same value of constitution. Therefore, our government should keep pace with times, change strategy, reduce the damage of the public power to private properties as far as possible, and balance the relationship between the state and citizens.
