在"专利标准化"与"标准专利化"趋势影响下,标准必要专利布局与企业标准化工作的结合日益紧密。根据当前国际标准化及产业竞争大环境,标准必要专利布局指南的编制须立足国际贸易和产业竞争,专利与标准结合及企业的具体实践。在尽快推出指南正式版并组织实施的同时,针对重点领域和产业,细化标准相关规定;以指南的研究、制定、发布、实施为契机,推动形成标准研制与专利布局有效衔接机制。

Under the influence of the trends of ＂Standardization of Patents＂ and ＂Patentization of Standards＂, the combination of the SEP layouts and the standardization activities of enterprises has become been increasingly closer. In the current situation of international standardization and industrial competition, the work of drawing up the guidelines of SEP layouts should highlights international trade and industrial competition, the combination of patents and standards, as well as practices of enterprises. While launching the official version of the guide as soon as possible and organizing the implementation, the relevant provisions on key areas and industries should be refined and detailed as well. The research, formulation, release and implementation of the guidance, will be taken as an opportunity to promote the formation of an effective convergence mechanism between standard developments and patent layouts.
