论赔偿委员会的重构

人民法院赔偿委员会是专门负责司法赔偿的审判组织,其设置具有法定依据和特定运作方式。目前,赔偿委员会在权限、工作方式、组织形式、审理程序等方面有诸多弊端。针对其存在的若干问题,合理设置这一机构应综合考虑我国的宪政制度、司法体制、实体与程序相结合等相关因素。为推动法治中国建设和人权保障事业的协调发展,亟须从其重构的独立性、成员结构任命模式和审理程序方式及其组织机构上进行完善。

The compensation committee of the people＇s court dieial compensation, it is set with the legal basis and specific is the judicial organization which is responsible for juoperation mode. At present, the compensation commit- tee has many defects in the aspects of authority, work methods, organization form, trial proceedings. Aimed at the problems existed, the related factors of the constitutional system in our country, the judicial system, combination of entity and procedure should be considered to establish of the institution reasonably. In order to promote the coordi- nated development of China＇s construction and the cause of the human rights protection under the rule of law, it is urgent to improve the compensation committee from the independence of reconstruction, appointed model of member structure , the way of trial procedure and its organization.
