本文梳理了美欧数据跨境流动政策的发展脉络,并通过对政策驱动、目的、实施机制的详细对比,澄清有关该政策的基本认知。分析了全球数据跨境流动政策的基本走向及其对跨境业务的影响,分别面向政府、企业提出相关建议。对于政府来说,对于跨境数据流动的干预愈深,则面临的实施挑战愈大,欧盟对跨境数据流动制度的反思与改革值得借鉴;对于企业而言,除了在合规层面,满足各国数据跨境流动政策要求外,也需要在技术架构、商业模式等多方面进行改进优化。

] This article reviews the context of cross-border data flow Policies in the United States and Europe and clarifies the basic understanding of the policies through a detailed comparison of policy-driven, purposes and implementation mechanisms. It analyze the global trend of cross-border data flow policies and their impacts on cross-border business, and makes correlative recommendations to the government and enterprises. For the government, the more interference with the cross-border data flow, the greater challenges. The EU＇s reflection on and reform of the institution of cross-border data flows could be adopted as a reference. For enterprises, in addition to compliance at the national level, not only should we meet the requirements of cross-border data flow policy, but also need to optimize the technical architecture and business models.[
