犯罪构成理论视角下的刑法学教材选型

犯罪构成理论在犯罪体系及整个刑法学体系中占据核心地位。刑法学教材对犯罪构成理论体系的不同选择,对法学教学有重大影响。目前国内刑法学教科书采用的犯罪构成理论主要有四要件说,三阶层体系和两要件二阶层理论三大理论体系。与我国传统的四要件说相比,两要件二阶层理论以阶层递进的评价方式,更加符合人类认识犯罪的基本规律,更加契合司法实践中对犯罪成立与否的判断进路。与三阶层体系相比,两要件二阶层理论传承了四要件说的有益成果,兼容性强,推行成本小,可以减少为新理论体系的完善和普及而投入的社会资源。采用两要件二阶层理论体系的刑法学教材是刑法学的最佳选择。

The crime constitution theory plays the key role in the criminal system and the whole criminal law system. The different choice of the textbook of criminal law with the crime constitution theory, affect the law teaching hugely. The domestic criminal textbooks mainly adopt three kinds of criminal theory system at present. Comparing with traditional four elements of crime consti- tution theory, two elements ＆ two levels theory is more in line with the basic rules for people to identify the criminal by progres- sive assessment style. Comparing with the three levels criminal system, this theory inherit the useful achievement of the four ele- ments of crime constitution theory. It has strong compatibility and its implementing costs very low. It can reduce the investment of social resources for improvement and popularization a new theory system for the benefit of the criminal construction. The criminal textbooks that chosen the new theory system are the best choice.
