论党规的概念、范围与效力等级

On the Concept,Scope and Grade of Effectiveness of Party Regulations

党内法规是中国共产党管党治党的重要依据,也是建设社会主义法治国家的有力保障。按不同口径将党规划分为三个层次:第一层次是按照中共党内法规制定条例口径界定的党规;第二层次是按照中共党内法规备案口径界定的、第一层次之外的党规;第三层次是"党的规矩"中不具有规范形式的不成文规矩。三个层次的的党规是互不包含关系。按效力等级划分,中共中央制定的"党章"效力等级最高;中共中央制定的其他形式的党规效力居第二位;中共中央各部委制定的"部委党规",居于效力等级第三位;中国共产党各省市自治区委员会制定的"地方党规"居于效力等级第四位。三个层次、四个效力等级的党规构成了中国共产党赖以规范自身的党规体系。

Party rules are not only the important basis of regulating and governing the party by CPC, but also a powerful guarantee for building a socialist law state. We can divided party rules into three levels according to the different calibers ： Party rules of the first level are those defined according to the ordinance of formulation of the party regulations ; party rules of the second level are those defined according to the ordinance for the record of the party regulations, but not include the first level ; party rules of the third level are unwritten rules without the normative form. Party rules of all the three levels do not contain each other. According to the grade of effectiveness, the Party Constitution enacted by the CPC Central Committee lies in the position of the highest grade ; party rules of other forms enacted by the CPC Central Committee lie in the position of second grade; party rules enacted by ministries and commissions of CPC lie in the position of third grade; local party rules enacted by the CPC Committee of provinces and autonomous regions lie in the position of forth grade. All the party rules of three levels and four grades constitute the system of party regulations of CPC by which the party unifies itself.
