论知识产权国际扩张中的权利观念嬗变

On the Evolution of Rights Concept in the International Expansion of Intellectual Property Right

针对知识产权的大规模国际扩张,与既有研究侧重于分析法律规则演变不同,有必要对重要社会成员的权利观念嬗变进行理论考察。通过考察可以发现存在三个主要变化:在权力前提上,实现了从独立保护到有限主权;在权利性质上,实现了从垄断特权到至上私权;在授权方式上,实现了从保守限权到激进授权。微软等公司遭受反垄断调查,有利于在我国形成一种平衡的知识产权权利观念。

Aiming at the large-scale international expansion of intellectual property right,being different from the existing explanation focusing on rules evolution analysis,it＇ s necessary to probes deeply into what evolution in the concept of rights those important members of society have experienced. By investigation,It can be found there exist three main changes as following： in the right premise,having realized from independent protection to limited sovereignty; in the right nature,having realized from monopoly privilege to highest private right; in the authorization option,having realized from limiting right conservatively to radical empowerment. The antitrust investigation suffered by Microsoft etc contributes to construct a balanceable concept of rights.
