Analysis of the Major Social Conflict in New Era and Its Values in Perspective of Equity

十九大报告从"供给—需求"的角度提出了新时代中国社会主要矛盾的新变化,供给侧与需求侧之间矛盾的根本解决路径是调和二者之间的关系,亦即一个趋向平衡的思路。这与平衡法的精神内涵与价值追求存在暗合。将平衡法理论代入到政治、经济、文化、社会等不同社会矛盾场域进行"权力(利)——义务"的解构分析,有助于我们深刻理解新时代社会主要矛盾论断的科学性,有益于发掘新时代主要矛盾间的联系,促使物本法律观向人本法律观转换,最终有助于实现善治的要求。

According to the latest change in China＇s major social conflict put forward in the 19th Session of National Congress of the CPC ,the final resolution of the conflict between supply side and demand side is to adjust their co-relation,i.e, a balance-tended ideology,which coincides with the spirit and value of Equity. With deconstructive analysis of the right-duty co-relation by using Equity in political, economic, cultural and social conflicts, we are equipped to have deeper understandings of the reasonableness of the new social conflict theory. The thesis is expected to explore the links among the main conflicts,impel a shift from material-oriented view of law to a human-oriented view of law and ultimately realize perfect rule.
