摘要
强化教育法哲学的研究对于教育法学学科建设非常必要。新学科是在原有学科内容的基础上产生的,教育法哲学视阈集合了原有学科内容和方法,形成了新的学科内容和方法。教育法哲学中的哲学导向包括人的发展的无限性、抽象性和目的性;教育法哲学中的法学定位包括人的发展的规范性、有限性、交互性和利益性;教育法哲学中的教育学定位包括人的发展的全面性、阶段性、专门性。教育法哲学应包括哲学的、法学的、教育学的基本概念与范畴。
It is very necessary for the construction of the discipline of education law to strengthen the research of the philosophy of education law.As a new discipline is born based on the content of the original one,the new content and methodology of the philosophy of education law is formed on the basis of the original one.The philosophic orientation of the philosophy of education law includes the infinity,abstractness and purposefulness of human development. The legal orientation of the philosophy of education law implies that human develop normatively,limitedly,interactively and trend towards interests. The educational orientation of the philosophy of education law involves the comprehensiveness,stages and particularity of human development.The philosophy of education law should contain the basic concepts and categories of philosophy,law and education.
