摘要
教育法律制度应当是以权利为本体的,是解放人、发展人的而不是限制人的,因此设定教育法律制度时,应当首先考虑其正义性目标。正义是公正、公道、平等、自由的限度,也是效率的限度,具有向善性,这是它最根本的性质和目的。教育法律制度对正义的追求就是对社会善的追求,实现教育法律制度的社会善就实现了其正义性目标。教育法律制度包括义务本体制度与权利本体制度两种。正义性的教育法律制度按照简单平等与复合平等相结合的原则设定。首先要确定有关教育的基本价值,并按照正义的要求对这些基本价值进行定义,从而建构实现简单平等的教育法律制度,在此基础上,在充分考虑人们对教育物品分配的需要、动机、业绩、资格等因素的情况下,建构以复合平等为核心的教育法律制度。
When the education law institution is enacted,the justice objectives should be calculated at first because the education law institution should be that its right be its noumenon,it should liberate and develop human. The justice,which has the essence of good which is ultimate trait and purpose,is the bound of the equity,the imparity,the fairness and the freedom, and efficiency too.The education law institution pursues justice is equal that it does social good,and the institution realize its social good is equal that it does justice purpose.The education law institution is formed by two types: the obligation-based institution and the right-based institution.The justice education law institution is enacted according to the principle which the basic fairness principle is the combined with multiplex fairness principle and according to person's need,motivation,performance,and qualification and other's facts.
