摘要
教师集体劳动权对于教师具有重要意义,但我国教师集体劳动权在立法上基本上处于空白状态,使教师难以依靠集体的力量保护自身的劳动权利。日本和美国对教师集体劳动权的相关规定,在一定程度上发挥了保护教师个体劳动权利、减少个体劳动争议的作用,这对于我国保护教师合法权益、改善教师弱势地位具有一定的借鉴意义。
Collective rights of labor are important for teachers in China, but most of them are not set in laws.Regulations referred to collective rights of labor in Japan and the United States have great effects to protect teachers' individual rights of labor and to reduce labor disputes.We can learn from these legislations to protect teachers' legal rights and to change their disadvantage role.
