国际仲裁中仲裁庭秘书之研究

Research upon Tribunal Secretary in International Arbitration

国际仲裁实践中，仲裁庭秘书的角色原本没有受到足够多的重视。但近年来，不同国家的司法实践中发生了多起案件，仲裁当事人以仲裁庭秘书不法干涉案件实体事项或仲裁员不当委任专属职责为由，请求法院撤销仲裁裁决，从而引发了对仲裁庭秘书的大讨论，仲裁庭秘书才从幕后走到了台前。本文以多个仲裁机构和组织所制定的调整仲裁庭秘书的规范性文件为蓝本，同时结合已发生的多个司法案例，对仲裁庭秘书的选任条件、冲突审查、工作范围等七个事项予以比较分析，再引以为鉴，详加分析我国仲裁实践中的办案秘书的角色并提出可行性建议。

In the course of international arbitral practice, the role of tribunal secretary does not obtain sufficient attention in the previous periods. But in recent several years, there has happened many casesamong various countries＇ judicial practices, that party to arbitration applied to vacate award before court for the reason that tribunal secretary illegally interfered substantive matters of case or arbitrators unduly dele- gated personal duties to tribunal secretary, thereby causing fierce discus- sions concerning tribunal secretary, tribunal secretary just emerges from the back to front stage. This article is based on normative documents re- lated to tribunal secretary enacted by a number of arbitration institutes and organizations, meanwhile combining with many judicial cases oc- curred, then comparing and analyzing the tribunal secretary＇s condition for appointment, conflict check, duties and with seven relevant issues in total, afterwards take it as an example, to specifically assess the role of case secretary in China＇s arbitral practice and give out some feasible sug- gestions.
