已撤销国际商事仲裁裁决在我国的承认与执行问题探讨

随着跨国交易的不断发展，必然会出现越来越多的贸易摩擦，仲裁作为一种效率高、保密性强的争议解决方式已经得到越来越多当事方的认可。由于国际商事仲裁裁决的增多，我们不得不考虑一个问题，即已被撤销的国际商事仲裁裁决是否还能得到其他国家的承认与执行。比较德国、法国与美国对该问题的不同态度，笔者认为美国的做法有一定的灵活性。我国对已被撤销的国际商事仲裁裁决的规定过于僵硬，没有给法官一点自由裁量的空间，笔者认为这样的规定有一定的弊端。笔者认为对于已被撤销的国际商事仲裁裁决在满足一定条件的前提下，我国可以有条件地承认与执行。

With the development of cross-border transactions, it is bound to be more and more trade friction . Arbitration which as a way of dispute resolution with high efficiency and confidentiality has been recognized by more and more parties . With the increase of international commercial arbitration, we have to consider a question that an Interna- tional Commercial Arbitration already been revoked and whether it can get the recognition and enforcement in other countries again. Comparing the different regulations about this question of Germany, France and the United States, I believe that the US approach has a certain flexibility. Our country＇s regulation about revoked international business arbitration provisions are too rigid and did not give the judge a little discretion space, I believe that such a provision has some drawbacks. ! believe that if it is satisfy certain conditions, the international business arbitration which has been revoked can be recognized and enforced.
