摘要
中国特色公职律师制度是在律师管理体制重塑、全面实现保障律师执业权利、系统推进法治政府建设等宏观背景下展开试点的。公职律师制度的试点激活了我国政府体系内法治人才队伍的活力,但在公职律师制度试点中公职律师的职责划分、权利义务设定、履职保障、职级晋升等方面尚有可完善之处。建议通过公职律师的省级统管、设立公职律师专业技术职称序列、建立不同类型律师之间转换和流动的渠道等路径,完善我国公职律师制度。
The pilot scheme of the public lawyer system with Chinese characteristics was carried out in the macro background of reshaping the lawyer management system,guaranteeing the lawyers’practice right and propelling the systemic law-based government construction,etc.The pilot scheme has activated the vitality of the government staff of law.Nevertheless,in the pilot practice,the classification of responsibilities,the setting of rights and obligations,resumption guarantee,and professional promotion,etc.,still have a certain room to perfect.The author of this paper suggests some ways to perfecting the system,such as practicing province-level unified management,setting public lawyer professional title order,establishing the channel for various types of lawyers to transfer and flow,etc.
