族群法治知识在民族地区生态治理中的应用路径研究--基于青海H县草原生态保护的田野调查

THE APPLICATION OF ETHNIC RULE OF LAW KNOWLEDGE IN ECOLOGICAL MANAGEMENT OF MINORITY AREAS:TAKING H COUNTY IN QINGHAI PROVINCE AS AN EXAMPLE

酝酿于特定历史语境与特定历史实践中的地方性知识,放置于民族法学视阈下,亦同时构成了关乎现代法治建构的族群法治知识。族群法治知识的概念一经提出,便成为对当代法治实践具有启蒙意义的新"范式"。青海H县的牧民们在长期的生产生活中所积累的关于草原生态保护的族群法治知识,在由民族地方立法所引导的官方法律表达中,尚未被完全涵盖。在民族地区生态治理现代化的进程中,应该重拾并利用起这些极具民族特色与地方特色的族群法治知识,并在此基础之上实现族群法治知识与官方法律表达的融通与共治,从而实现民族地区生态治理模式的转型与优化。

The local knowledge brewed in is now placed under the perspective of national specific historical context and specific historical practice law and constitutes a knowledge of ethnic rule of law in the construction of modern rule of law. The concept of rule of law knowledge of ethnic groups has become a new ＂paradigm＂, which has enlightening significance to the practice of the rule of law in the contempo- rary era. The rule of law knowledge about grassland ecological protection accumulated by the herdsmen in H county, Qinghai has not yet been completely covered in the official legal expression, which is guided by the national local legislation. It is necessary to regain and utilize the knowledge of ethnic groups with local characteristics in the process of modernization of ecological governance in minority areas, and on the basis of this to realize the integration of the knowledge of ethnic rule of law and the official legal expres- sion, so as to achieve the transformation and optimization of ecological governance model in these areas.
