摘要
WTO现行上诉机构成员任命机制在实践运用中产生了成员国滥用反对权,上诉机构工作过载、上诉机构成员席位长期空缺以及选任资质标准不清等问题。上述问题的产生是国家利益博弈的内因与制度设计缺陷的外因合力作用的结果。因此,以增加上诉机构人数、延长任期、完善补选衔接制度并实行本国回避制度的方式弥补制度缺陷,以外交协调手段疏导国际利益博弈是可行的完善路径。
In practice,the member appointment mechanism of the existing appellate body has resulted in the abuse of opposition by the member states,the work overload of the appellate body,the permanent vacancy of the member of the appellate body,and the unclear criteria for the selection of qualifications. The emergence of the above problems is the result of the combination of internal cause and system design flaws in the national interest game. Therefore,increase the number of the appellate body,longer term challenge system,perfect the system of by-election cohesion and implement their own way to make up the defects,with diplomatic channel coordination means the improvement of the international interest game is feasible path.
