美国、法国等发达国家在隐私权保护方面已作出了较完善的立法保护,而我国现行法律中对未成年人隐私权仅有笼统性、原则性的规定。对未成年人隐私权保护的立法规定,确有必要。立法上,应当依据未成年人的年龄作出不同档位的主体划分,并对"隐私"的范围进行分门别类的界定;在行为构成上要严格符合三要件立法设计;在司法运行上,要完善立法对诉前前置程序的法律确认,为司法能动性的提升提供确切有力的法律依据。

In US,French etc.developed countries,the lawmaking protection on the right of privacy have already been more perfect.In China current laws only have general and principle provisions on non-adults' right of privacy.It is a necessity to protect non-adults' right of privacy from lawmaking.In legislation,classify the different corpuses by their ages,and based on these,classify the rages of'privacy'.The behavior constitution should meet the three essentials.In key and legal link,perfect the legal confirmation before charge,and provide powerful legal supports to improve the judicial initiative.
