Choosing the Closest Prior Art Based on Understanding the Idea of Invention

理解发明应当结合申请文件和现有技术从整体上进行理解,理解发明不应仅是技术特征的对比,还需从发明构思上进行分析,把握发明的实质。在进行创造性评判中,通常采用一下三步:(1)确定最接近现有技术;(2)确定发明的区别特征和发明实际解决的技术问题;(3)判断要求保护的发明对本领域的技术人员来说是否显而易见。把握发明构思的理念应贯穿以上三个步骤的始终,即以最接近现有技术为起点,技术问题为指引,寻求获得发明的途径,判断其中的智慧贡献^([1])。

Understanding the invention should be combined with the application documents and the prior art from overall understanding, understanding the invention should not only be a comparison of technical features, but also from the concept of the invention to grasp the essence of the invention. In the creative judgment, we usually take three steps：（1）to determine the closest prior art;（2）to determine the difference of the technical features between the present invention and the closest prior art, and determine the actual technical problems of the invention;（3）to judge the invention whether it is obvious for the skilled person in this field. The idea of grasping the idea of invention should always be through above three steps, in a word, taking the closest prior art as a starting point, and relying on the technical problems as a guide to seek the invention access, finally determining the wisdom contribution of the invention.
