农村土地承包经营权流转法律制度构建的若干问题研究

通过对我国农村土地承包经营权流转法律规范内容所具备的"政策性"和"阶段性"特征的揭示和分析,提出在既存法学理论及国外法制无法提供指导和制度借鉴的情况下,我国农村土地承包经营权流转法律制度构建所必需的两个前提:流转的现实基础及前提性法律技术,并对这两个前提的内容作了详细阐述,基于此,设置了农村土地承包经营权流转法律制度构建的回应性及协调性二维路径。
