巴西反垄断法执法机制述评

Introduction and Commentary of Enforcement Mechanism of Brazil Competition Law

巴西于1962年颁布反垄断法,1994年8884号反垄断法规定了反垄断法执法机构的设置及其执法程序。在反垄断法实施过程中,巴西反垄断法执法机构致力于执法措施的创新,使反垄断法执法更加合理与高效。巴西反垄断法执法机制的发展表现出由严格管制到放松管制、由结构规制到行为规制、由固守法条到勇于创新的趋势。但仍然存在对垄断行为的执法效率不高、企业结合申报机制不完善、执法创新实践效果不明显的问题。

Brazil competition law was enacted in 1962 and was revised for a few times.No.8884 Act of 1994 provided the construction of enforcement agency and its procedure.Brazil enforcement agency of competition law devotes to innovation to improve efficiency.The trade,from strict regulation to lenient regulation,from structure control to conduct control,as well as from traditional ideology to creative ideology,could be found during the enforcement.However,the problem of low efficiency, the shortcoming of merger report procedure and unobvious effect of innovation still exist.
