部门法学著作的新视野:在规范与事实之间展开——读邵建东、方小敏、王炳、唐晋伟编著的《竞争法学》

A New Horizon of Works about Branches of Law:Expanding Between Rules and Facts——Writing for Competition Law by Shao Jiandong,Fang Xiaomin,Wang Bing and Tang Jinwei

在我国,部门法学著作有两个偏向,一是侧重于我国现行法律文本的梳理,二是侧重于抽象的部门法学理论的探讨。前者导致的结果是许多部门法学著作的法条化;后者导致的结果则是一些部门法学著作宛似空中楼阁。部门法学著作克服前二者的理想做法应是在规范与事实之间展开,即将法律文本与生活事实有机结合起来,以研究法律是什么。邵建东、方小敏、王炳、唐晋伟编著的《竞争法学》从我国当下的法律规范与事实之间展开,并注意域外法律文本和事实的采掘和借鉴,强调了对竞争程序法的立法与实践的分析,向我们展示了部门法学著作的新视野。

In China,works about branches of law have two tendencies: some works focus on interpretation of Chinese laws and regulations,and some works discussion of abstract theory about a branch of law.The former often turns a work about a branch of law into a stack of articles of law;the later makes a work about a branch of law metaphysical.The correct method of avoiding the two things above for works about branches of law is to integrate rules and facts,then study the true meaning of law.Competition Law by Shao Jiandong,Fang Xiaomin,Wang Bing and Tang Jinwei,catching hold of Chinese laws and true life nowadays tightly,paying attention to foreign laws and facts properly and attaching importance to analysis of legislation and its run of competitive procedure law,shows us a new picture of works about branches of Law.
