在以审判为中心的刑事诉讼制度改革中,完善对鉴定人的法庭质证规则,落实鉴定人出庭作证制度,是其中的重要内容。而完善《刑事诉讼法》第192条第2款规定的"有专门知识的人"制度,也是应有之义。我国现行法律没有对"有专门知识的人"的资格要件进行明确规定。英美法系从专业知识和公正性两个方面探讨专家证人的资格要件,对我国"有专门知识的人"具有重要的借鉴意义。
