由于飞速发展的互联网技术与我国立法、管理机制严重不协调等因素,使得患者隐私权受到侵害。患者隐私数据泄露事件频发,媒体中也多有报道。如何在医疗大数据时代更好地保护患者隐私权日益受到社会广泛关注。本文分析了医疗大数据时代患者隐私权的新变化,并在借鉴美国保护患者隐私权经验的基础上,尝试提出大数据背景下保护患者隐私权的相应解决对策,以期寻求患者隐私权保护与医疗大数据发展之间的平衡与共进。

The invasion of patients＇ privacy has been happened on the ground of the serious incompatibility between the rapid development of internet technology and the legislative management mechanism.Patients＇ privacy disclosure is also reported by media recently.In the era of big data,the protection of patients＇ privacy catches social attention day by day.This article analysis the new changes about patient＇s privacy in the era of big data.Based on the experience of patient＇s privacy in the United States,some countermeasures and suggestionsare put forward accordingly,aiming to provide a better development environment for the balance between the protection of patient＇s privacy and the medical development under big data.
