农村宅基地房屋买卖效力及其法律纠纷处理探析 被引量:3

摘要 案例统计分析表明,当前司法实务中以农村宅基地房屋买卖无效作为裁判结果的主流。学术界对法律规范适用提出各种论证和质疑,并通过解释论的体系运用和立法论的理论构建,形成了既有的解决问题的各种观点。在规制目标明确的裁判实务语境下,关注各种观点和学说的科学性,有其现实意义。在法律纠纷处理的路径上,运用合同无效的损害赔偿解释论,对请求权基础、责任认定、赔偿范围进行梳理和论证,提升问题解决的合理性和实效性。 Case statistical analysis on the current judicial practice in the sales of rural homestead housing shows that the invalid judgment is the mainstream. Academic theories propose various arguments and doubts on the application of law. The interpretation theory and the utilization of the legislation theory lead to a variety of solutions to the problem. In the context of surveillance practice,attention to all kinds of viewpoints and theories is of practical significance. The paper maintains that the theory of compensation for damage of invalid contracts is the most reasonable solution to the legal disputes. On this basis,the analysis and demonstration of these theories,such as accordance of right of claim,responsibility determination,scope of compensation,helps enhance the rationality and effectiveness of handling legal disputes.
