Academic theories propose various arguments and doubts on the application of law. The interpretation theory and the utilization of the legislation theory lead to a variety of solutions to the problem. In the context of surveillance practice,attention to all kinds of viewpoints and theories is of practical significance. The paper maintains that the theory of compensation for damage of invalid contracts is the most reasonable solution to the legal disputes. On this basis,the analysis and demonstration of these theories,such as accordance of right of claim,responsibility determination,scope of compensation,helps enhance the rationality and effectiveness of handling legal disputes.
