我国医疗纠纷调解制度实证分析及完善

Analysis and Improvement of Mediation System for Medical Disputes in China

医疗纠纷调解制度已经在我国部分城市和地区推行。通过对北京与天津地区某些医院和患者走访和问卷调查,了解到医疗纠纷调解制度在我国已经取得了较好的效果,不但处理了大量医疗纠纷,而且还在一定程度上缓和了医患关系。但是,在医疗纠纷调解过程中也存在着关于调解制度公正性的质疑,以及医患关系未能完全修复的问题。因此,我国可以借鉴德国的医疗纠纷鉴调制度增加调解的公正性,以及将叙事医学理论应用于医疗纠纷调解以加强该制度修复医患关系的作用。

Mediation system for medical disputes has been put into practice at some regions and cities in China.A questionnaire survery has been conducted within hospitals and patients in Tianjin and Beijing.The results show that mediation system has made several achievements,as it has not only solved many medical disputes but also improved the relationship between doctors and patients.However,in the meantime,there are still some problems including questioning the justice of mediation system and difficulty to completely repair the relationship between doctors and patients.Therefore,Germany Mediation System for Medical Disputes could be used for reference to enhance the justice of mediation system in China.Meanwhile,by introducing theory of narrative medicine into the mediation process,the doctor-patient relationship could be expected to heal.
