评网络行动对海洋法制度带来的问题与争议——以塔林2.0为研究范本

Comment on the Problems and Controversies in the Rules of Laws of the Sea Brought by Cyber Operations——Taking Tallinn Manual 2.0 as a Model

《塔林手册2.0版》是目前国际上唯一一部专门以"可适用于网络行动的国际法"为主题的国际法著作。在当前网络空间国际法(主要是硬法)规则严重缺位的情况下,国际软法大行其道,填补了网络空间的诸多法律空白。本文就可适用于网络行动的海洋法规则为视角,对《塔林手册2.0版》中海洋法部分内容做一深入分析,并主要围绕网络行动对传统海洋法提出的新问题和争议进行研究。通过梳理总结出塔林2.0中海洋法规则的几大特点,以及据此得出的几点启发。

Tallinn Manual 2.0 has been the only one International Law work with the theme of＂the International Law Applicable to Cyber Operations＂at present around the world. Under the circumstances that efficient International Law rules on cyberspace have been seriously inadequate,soft international law have been quite prevailing,and they fill in the vacancy in the law regarding the cyberspace. From the perspective of rules of laws of the sea applicable to cyber operations,this article further analyzed and studied the part of laws of the sea in Tallinn Manual 2.0,and mainly researched the new problems and controversies thereinto,summarizing their characteristics,and accordingly drawing some inspiration.
